Monitor strengthens the hand of the NHS Co-operation and Competition Panel

In January 2009, the Co-operation and Competition Panel for NHS-funded services opened for business. The panel will investigate and advise the Secretary of State for Health and Monitor on potential breaches of the Principles and Rules for Co-operation and Competition (PRCC).

Monitor announced on 31 March 2009 that foundation trusts are now subject to the PRCC under the terms of their authorisation and compliance framework. This represents a considerable extension to the enforceability of the new rules.

The panel has published draft guidelines for consultation which set out its approach to the different types of cases that it may undertake and how it will discharge its responsibilities under the PRCC.
