Sky proves fraud against EDS
27.01.10
The long-awaited judgment of Mr Justice Ramsey in the case of BSkyB Limited (Sky) v Electronic Data Systems Limited (EDS) was handed down yesterday with EDS, now owned by Hewlett Packard, found liable for deceit, misrepresentation and breach of contract. The judgment, which constitutes a major victory for Sky, is one of the most significant commercial cases to come before the courts for many years and its commercial and legal impact is going to reverberate through the IT industry and beyond.
We are in the process of analysing the judgment, which runs to some 468 pages, and will be commenting upon its implications in more detail in a further alert. In the meantime, Wragge & Co's experts comment upon some of the headline points in the judgment.
