Agency workers and pensions: there's no escaping 2012 Workplace Pension Reform!

The Agency Workers Regulations 2010 (the Regulations) are due to come into force in October 2011. This is the Government's way of achieving "flexisecurity" for agency workers. The Regulations aim to ensure that agency workers are provided with the same basic working and employment conditions as if they had been directly employed by the company for which they are carrying out the work. Under Regulation 6 "basic working and employment conditions" include pay and "working time" type conditions such as duration of working time, length of night work, rest periods, rest breaks and annual leave. Employers should however be paying as much attention to what the Regulations do not cover as to what they do cover.
