Employment litigation

Having the right team in place is essential in an employment dispute. Wragge & Co's 36-lawyer Employment team provides strategic and tactical advice and support to see you safely through a dispute and secure the right commercial outcome.

While the whole team handles employment disputes, about half concentrates exclusively on their resolution. This focus gives its experts a head start when assessing a situation. They look at all the options to make sure their advice fits the situation. This might mean mediation, a robust defence at trial or coming up with a creative alternative. If it comes to a fight, the team has a success rate in excess of 95%.

Work ranges from simple termination for gross misconduct to highly complex multi-party equal pay litigation and enforcing post-termination restrictions in the High Court. One high-profile example saw the team stop a former Dyson design engineer from working in vacuum cleaners for his new employer, Black & Decker, for 12 months after he left.

The team is also active in the developing field of inter-employer and employer/union disputes arising out of business transfers and outsourcings.

An innovative 'slice and price' approach to tribunal cases proves excellent client service and cost certainty can go together. After an initial discussion about the implications of the issue at hand, a work scope and precise cost can be agreed. This innovation was rated stand-out by the Financial Times Innovative Lawyers report. It has been used to good effect managing tribunal claims for Toyota, among others.

Every one of the team's litigators is experienced in acting for respondent clients before tribunals and the Employment Appeal Tribunal. The team also includes solicitor advocates Shirley McAloney (shirley_mcaloney@wragge.com), Mark Greenburgh and Trevor Gibson (a former barrister) able to represent clients in hearings before all courts in England and Wales.

Employment law specialists prepare regular monthly and ad hoc alerts on legal issues, analysing the legal position and providing practical tips for you to use. They also run seminars, breakfast briefings, workshops and bespoke training courses to help clients stay on top of changes in the fast-moving world of employment law.

Clients include Dyson, Toyota, Willis, Sanctuary Housing Association and Stoke-on-Trent City Council.
